Sun Estimate ("Sun Estimate," "we," "our," or "us") provides solar estimation, proposal generation, lead matching, and related software services for homeowners and solar industry professionals. This Privacy Policy explains how we collect, use, process, disclose, and protect personal information when users access our website, applications, calculators, APIs, and related services (collectively, the "Services").

By accessing or using the Services, you acknowledge that you have read and understand the data practices described in this Privacy Policy. Where California law or other applicable law requires affirmative consent that is separate from general platform use, including prior express written consent to receive marketing communications under the TCPA, or the right to opt out of the sale or sharing of personal information under the CCPA/CPRA, your rights are governed by the specific provisions addressing those matters in this policy. Your use of the platform does not constitute a waiver of any privacy right you hold under applicable law.

What Information Do We Collect?

We collect personal information directly from users, automatically through the Services, and from third-party sources.

Information Provided Directly by Users

We may collect personal information provided directly by users, including full name, email address, phone number(s), property address, utility provider information, historical or estimated electricity usage, roof and property characteristics, financing preferences, project goals and solar preferences, communications submitted through forms, chats, SMS, or email, account credentials and login information, as well as business information submitted by solar providers.

Information Collected Automatically

When users interact with the Services, we may automatically collect information such as IP address, browser type and device identifiers, operating system information, website activity and navigation behavior, session activity and referral URLs, approximate geolocation data, as well as cookies and similar tracking technologies.

Information From Third Parties

We may receive information from third parties, including solar provider partners, lead generation or marketing partners, utility data integrations authorized by users, public property and satellite databases, analytics and advertising platforms, as well as Google Solar API and related Google services.

How Do We Use Your Personal Data?

We use personal information to operate, improve, personalize, and secure the Services, including to generate solar estimates and proposals, match homeowners with solar providers, analyze roof suitability and solar production potential, process and respond to user inquiries, deliver calculations and recommendations, facilitate financing inquiries, communicate regarding requested services, improve platform functionality and user experience, detect fraud, abuse, or unauthorized activity, comply with legal obligations, as well as market products or services where permitted by law.

We may also use aggregated or de-identified data for analytics, platform optimization, benchmarking, and business intelligence purposes.

How Do We Process Solar Estimation Data?

Sun Estimate integrates solar modeling technologies, including Google Solar API services and estimation systems, to generate customized solar proposals.

To generate estimates, we may process information including property address, roof orientation and geometry, shading and solar exposure characteristics, utility usage data, electricity rates, estimated energy consumption, battery storage preferences, and financing assumptions. These inputs are used to calculate estimated production, projected savings, system sizing, financing scenarios, and related proposal information.

How Do We Share Personal Information?

Solar Provider Partners (Lead Recipients)

When a homeowner requests a solar estimate, consultation, financing option, or connection with a solar provider through Sun Estimate, we may share, transfer, license, sell, or otherwise disclose personal information to one or more solar installation companies, financing providers, dealers, or related service partners.

This information may include name, email address, phone number(s), property address, utility usage information, roof and property characteristics, solar project preferences, proposal details, and financing interests.

Sun Estimate may receive monetary compensation or other valuable consideration in connection with these transfers. Under the California Consumer Privacy Act ("CCPA") and California Privacy Rights Act ("CPRA"), these disclosures may constitute a sale or sharing of personal information.

By submitting a request through the Services, users expressly consent to the transfer of their information to participating solar provider partners.

Solar provider partners may use the personal information they receive to communicate with users through telephone calls, SMS messages, email, messaging applications, app-based business messaging platforms, customer relationship management systems, and other lawful communication channels regarding solar products and services.

Once personal information is transferred, solar provider partners operate as independent businesses and independent data controllers responsible for their compliance with applicable privacy, marketing, consumer protection, anti-spam, and communications laws. Their use of personal information is governed by their own privacy policies and contractual obligations.

Solar provider partners who receive personal information through our platform are independently responsible for obtaining their own prior express written consent before initiating any telemarketing calls, automated messages, or promotional text messages, as required by the Telephone Consumer Protection Act (TCPA, 47 U.S.C. 227) and FCC rules effective January 27, 2025. Submission of a request through sunestimate.ai does not constitute TCPA consent to be contacted by any solar provider partner.

Third-Party Service Providers

We share personal information with vendors and service providers that process data on our behalf to support business operations and platform functionality, including cloud hosting providers, CRM and customer support platforms, email and SMS communication providers, analytics and reporting vendors, identity verification services, payment processors, as well as security and fraud prevention providers.

These service providers act as data processors under contractual obligations and may only process personal information for authorized business purposes. This type of disclosure is not considered a sale of personal information under CCPA/CPRA.

Google Solar API

Sun Estimate uses the Google Solar API and related Google services to generate solar production estimates and roof analysis data.

To retrieve solar potential data, we may transmit certain information to Google, including property address, geographic coordinates, roof characteristics, as well as solar exposure and shading data.

Legal and Business Transfers

We may disclose personal information to comply with applicable laws or legal requests, enforce our agreements or protect our rights, facilitate a merger, acquisition, financing, or sale of assets, as well as investigate fraud, security incidents, or unlawful activity.

How Do We Use Cookies and Tracking Technologies?

We use cookies, pixel tags, JavaScript tracking snippets, and similar technologies on sunestimate.ai to maintain core platform functionality, measure traffic and user behavior, personalize content and recommendations, and track the effectiveness of our paid advertising campaigns.

Our use of these technologies is described in full in our Cookie Policy, available at sunestimate.ai/cookie-policy. The Cookie Policy details the specific categories of cookies active on the platform (strictly necessary, functional, analytics, and advertising), the first-party and third-party cookies currently in use, and the choices available to you.

The tracking tools currently integrated into sunestimate.ai include Google Tag Manager, which manages the loading of other scripts; Google Analytics 4, which measures traffic and user behavior using pseudonymized data; and Google Ads conversion tracking, which connects paid ad clicks to completed estimates and supports remarketing. These tools are operated by Google LLC and the data they collect is processed subject to Google's privacy practices. No analytics or advertising cookies activate until you provide consent through the banner displayed on your first visit to the site.

We honor the Global Privacy Control (GPC) signal as an opt-out of the sale and sharing of personal information, as required by Cal. Civ. Code Section 1798.135(e). If your browser transmits a GPC signal when you visit sunestimate.ai, advertising and targeting cookies will not be loaded for that session, and no data constituting a share under the CPRA will be transmitted to third-party ad networks.

Users may also manage cookie preferences through browser settings or through the opt-out tools provided by Google at tools.google.com/dlpage/gaoptout and adssettings.google.com. Disabling strictly necessary cookies through browser-level controls may impair core platform functionality.

How Do We Handle Phone Calls, SMS, and TCPA Consent?

By submitting a form, requesting a solar estimate, or providing contact information through the Services, users provide prior express written consent, as that term is defined in 47 U.S.C. 227 and 47 C.F.R. 64.1200, to receive marketing and informational communications from Sun Estimate. Effective January 27, 2025, FCC regulations require that TCPA consent for telemarketing calls and text messages be obtained on a one-to-one basis, identifying by name the specific entity authorized to contact the user. Consent obtained through sunestimate.ai therefore authorizes Sun Estimate to contact users; it does not extend to solar provider partners. Solar provider partners who receive lead information through our platform must obtain their own separate prior express written consent before initiating telemarketing calls or promotional text messages.

These communications may include phone calls, automated dialing systems, artificial or prerecorded voice messages, SMS or MMS text messages, emails, as well as communications delivered through messaging platforms, instant messaging applications, app-based business messaging services, and other third-party communication channels, including WhatsApp, Facebook Messenger, Instagram Messaging, or similar services, regarding solar products, solar installation services, financing options, energy-related products, or related services.

Where required by applicable law, platform policies, or industry standards, such communications will be sent only after obtaining the necessary consent. Users acknowledge that communications may be delivered by Sun Estimate, its solar provider partners, financing partners, or service providers acting on their behalf.

For communications delivered through messaging platforms or app-based messaging services, including WhatsApp, users understand that additional platform-specific terms, policies, and consent requirements may apply. Sun Estimate and its partners will seek to comply with applicable platform requirements, including consent, sender identification, and opt-out obligations where applicable.

When a user has provided prior express written consent to Sun Estimate as described above, Sun Estimate may contact that user even if the phone number is registered with the National Do Not Call Registry or a state Do Not Call Registry. This exemption applies only to communications initiated by Sun Estimate itself, and only for so long as the user's consent remains valid and has not been revoked.

Message frequency may vary depending on user activity, provider participation, and project status. Standard message and data rates may apply based on the user's wireless carrier plan.

Users may opt out of SMS communications at any time by replying STOP to a text message or by contacting us directly. Users may also request to stop phone or marketing communications by following the instructions provided during the communication process.

Sun Estimate logs the time, date, page URL, and form context of each consent submission to document the existence of prior express written consent, in accordance with TCPA compliance requirements. Consent records are retained for a minimum of five years to support verification and regulatory compliance.

Wireless carriers are not liable for delayed or undelivered messages.

Consent to receive communications is not a condition of purchasing any product or service.

We may monitor or record calls for quality assurance, training, operational, and compliance purposes where permitted by law.

How Do We Handle Commercial Email and CAN-SPAM Compliance?

Sun Estimate may send commercial email messages to users who have provided their email address through the Services. All commercial emails sent by Sun Estimate comply with the requirements of the CAN-SPAM Act of 2003 (15 U.S.C. 7701 et seq.).

Every commercial email we send will clearly identify itself as a marketing or promotional communication where required by law.

Every commercial email will also include a functional opt-out link or mechanism allowing recipients to unsubscribe from future marketing messages. We will process unsubscribe requests promptly and will honor them within ten business days of receipt. Once an opt-out request has been processed, no further commercial email will be sent to that address by Sun Estimate.

Transactional and service emails, such as confirmation of an estimate request, delivery of your solar proposal, or follow-up on a submitted inquiry, are not commercial messages for CAN-SPAM purposes and will be sent as necessary to fulfill your request, regardless of marketing opt-out status.

Our marketing emails may contain tracking pixels that allow us to detect whether a message was opened and whether links were clicked. This data is used solely to evaluate the performance of our email communications and to improve the relevance of future messages. We do not use email engagement data to build behavioral profiles for sale to third parties. Users may disable email tracking by configuring their email client to block the loading of remote images.

WhatsApp-Specific Disclosure

For communications conducted through WhatsApp Business or similar messaging services, Sun Estimate and participating solar provider partners may rely on user opt-in consent before initiating communications. Such messages will identify the sending business and will include reasonable methods for users to stop or opt out of future communications, consistent with applicable platform requirements and business messaging policies.

How Do We Protect Your Information?

We implement commercially reasonable technical, administrative, and organizational safeguards designed to protect personal information from unauthorized access, disclosure, misuse, or destruction.

These measures may include encryption technologies, secure cloud infrastructure, access controls and authentication systems, network monitoring and security tools, as well as vendor security assessments.

However, no system or transmission method can be guaranteed to be completely secure.

How Long Do We Retain Information?

We retain personal information for as long as reasonably necessary to provide the Services, fulfill contractual obligations, comply with legal requirements, resolve disputes, enforce agreements, and maintain operational and business records.

Retention periods may vary depending on the nature of the information and applicable legal obligations.

As required by Cal. Civ. Code Section 1798.100(a)(3), the following describes the criteria we use to determine how long we retain each category of personal information we collect.

Contact identifiers, including name, email address, and phone number, submitted through estimate request forms are retained for the duration of our business relationship and for up to three years thereafter, or until a valid and verified deletion request is received.

Solar estimation data, including property address, roof characteristics, utility usage figures, and proposal outputs, is retained for up to three years to support follow-up inquiries and re-estimation requests.

Account credentials and login information are retained for the active life of the account and for up to 90 days following account closure.

Analytics and behavioral data collected through tracking technologies is retained in accordance with the retention settings of the applicable third-party platform. Google Analytics 4 data is currently configured with a retention window of 14 months. Cookie identifiers set on user devices expire on the schedules disclosed in our Cookie Policy at sunestimate.ai/cookie-policy.

TCPA consent records, including the timestamp, page URL, and form context of each consent submission, are retained for a minimum of five years to support compliance verification.

Communications submitted through forms, chat, or email are retained for up to three years from the date of receipt.

Personal information disclosed to solar provider partners and other third parties is subject to those parties' own retention schedules following transfer.

What California Privacy Rights Do Users Have?

California residents may have rights under the CCPA and CPRA, including the right to:

• Request deletion of personal information
• Request correction of inaccurate information
• Opt-out of the sale or sharing of personal information
• Limit the use of sensitive personal information where applicable

Sensitive personal information may include utility usage information, precise property data, financing preferences, and account credentials.

The categories of personal information that Sun Estimate may sell or share with solar provider partners include identifiers (name, email address, phone number), property address and geolocation data, utility usage information, solar project preferences, and proposal details. We do not sell or share sensitive personal information as defined in Cal. Civ. Code Section 1798.140(ae) for any purpose beyond those specified in Section 1798.121.

To opt out of the sale or sharing of your personal information, you may: (a) use the cookie preference controls described in our Cookie Policy at sunestimate.ai/cookie-policy; or (b) submit a written request using the contact information below. We also honor the Global Privacy Control (GPC) signal as a valid opt-out request under Cal. Civ. Code Section 1798.135(e). If your browser transmits a GPC signal when you visit sunestimate.ai, we will treat it as an opt-out of the sale and sharing of your personal information for that session and will not load advertising or targeting cookies.

To exercise California privacy rights, users may contact us using the information below. Users may also designate an authorized agent to submit requests on their behalf, subject to identity verification requirements.

We will acknowledge receipt of a verifiable consumer request within 10 business days and provide a substantive response within 45 calendar days of receipt. If we require additional time, we will notify you before the initial 45-day period expires and may take one extension of up to 45 additional days where reasonably necessary, for a maximum total response period of 90 days.

We will not discriminate against you for exercising any of the rights described in this section. This means we will not deny you access to the platform, charge different prices, provide a reduced level of service, or suggest that you will receive different treatment as a result of making a privacy request.

California Shine the Light Disclosure

California Civil Code Section 1798.83 gives California residents the right to request, once per calendar year, information about the categories of personal information we disclosed to third parties during the preceding calendar year for those third parties' own direct marketing purposes, and the names and mailing addresses of those third parties.

To submit a Shine the Light request, please send a written inquiry to the contact address in the How Can Users Contact Us? section of this policy, and include the phrase Shine the Light Request in the subject line or at the top of your correspondence. We will respond within 30 days of receiving a valid request.

How Do We Handle Children's Privacy?

The Services are intended for adults and are not directed toward individuals under 18 years of age. We do not knowingly collect personal information from children.

In accordance with Cal. Civ. Code Section 1798.120(c), we do not sell or share the personal information of any consumer we know to be under 16 years of age without affirmative authorization as required by that statute. If you believe a minor has used sunestimate.ai in a manner that resulted in the collection of personal information, please contact us at [email protected] and we will take prompt steps to delete any such data.

How Do We Update This Privacy Policy?

We may update this Privacy Policy periodically to reflect operational, legal, or regulatory changes. Updated versions will be posted with a revised Last Updated date.

Continued use of the Services after changes become effective constitutes acceptance of the revised Privacy Policy.

For material changes, meaning changes that meaningfully expand the categories of personal information we collect, introduce new purposes for which personal information is used, or add new categories of third parties to whom personal information is sold or shared, we will provide advance notice by posting a prominent announcement on sunestimate.ai or, where we hold a valid email address for the affected user, by direct notification before the change takes effect. Where such a change affects the sale or sharing of personal information, users will have the opportunity to opt out before the new practice begins.
